Terms of Service

These Terms of Service (“Terms”) govern your use of the PoppyLove Creations website and any purchases made through our website. In these Terms, “PoppyLove Creations”, “we”, “our”, and “us” refers to PoppyLove Creations (ABN 91 439 728 389), an Australian sole trader business. By accessing our website or purchasing our products, you agree to be bound by these Terms.

All PoppyLove Creations products are handmade. As each nail set is individually crafted:

• Minor variations may occur between product photos and the finished product
• Colours may appear differently depending on your device or screen settings
• Small differences between sets are considered normal and are not defects

We reserve the right to modify, update, or discontinue products at any time without notice.

Product Photography

Product photographs are provided for illustrative purposes only. While we make reasonable efforts to accurately display colours, finishes, and details, actual products may vary due to screen settings, lighting conditions, photography, and the handmade nature of our products.

Custom Commission orders are created based on information, inspiration images, and instructions provided by the customer. By submitting a Custom Commission request, you acknowledge that:

• Final designs may differ slightly from inspiration images
• Artistic interpretation may be required
• Production timelines may vary depending on complexity and order volume
• Once production has commenced, changes may no longer be possible

Custom Commission orders progress through a series of order statuses which may include: New Request, Awaiting Payment, In Production, Shipped, and Cancelled. Ready-to-wear orders progress through New Request, Preparing Order, Shipped, and Cancelled. Customers will be notified as their order progresses through these stages.

Custom Commission orders may not be eligible for cancellation, refund, or exchange once production has commenced, except where required under Australian Consumer Law.

Customers are responsible for selecting the correct nail size or providing accurate measurements. We strongly recommend using our Sizing Guide before placing an order. PoppyLove Creations is not responsible for sizing issues resulting from incorrect measurements or sizing selections provided by the customer.

All prices are displayed in Australian Dollars (AUD) unless otherwise stated. Payments are securely processed through Stripe. We reserve the right to:

• Change prices without notice
• Correct pricing errors
• Cancel orders affected by pricing, inventory, or technical errors

If a payment cannot be successfully processed, we may cancel the order.

An order confirmation email does not guarantee acceptance of an order. We reserve the right to refuse or cancel orders, limit quantities purchased, or cancel orders suspected of fraud, abuse, or misuse.

If an order is cancelled after payment has been received, a refund will be issued to the original payment method.

Ready-to-wear products listed for sale on our website are available for immediate fulfilment and cannot be cancelled once an order has been placed.

Custom Commission orders may be cancelled only before production has commenced. Once a Custom Commission enters production, cancellation may no longer be possible.

Nothing in this section limits any rights or remedies available under Australian Consumer Law.

Any production or fulfilment timeframes displayed on our website are estimates only. Production times may vary due to:

• Order volume
• Design complexity
• Material availability
• Public holidays
• Other circumstances beyond our reasonable control

We currently ship within Australia only. Processing and shipping timeframes are estimates and delays may occasionally occur. PoppyLove Creations is not responsible for delays caused by:

• Postal services
• Weather events
• Carrier disruptions
• Incorrect shipping information supplied by the customer

Once an order has been dispatched, delivery is managed by the shipping carrier.

Nothing in these Terms excludes or limits any rights available to consumers under Australian Consumer Law.

Due to hygiene reasons, used or worn nail sets cannot be returned. Nothing in these Terms excludes rights provided under Australian Consumer Law. Where required by Australian Consumer Law, customers may be entitled to a repair, replacement, refund, or other remedy.

All content on this website — including nail designs, product photographs, logos, branding, graphics, written content, and other materials — is owned by or licensed to PoppyLove Creations and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, sell, publish, or otherwise use our content without prior written permission.

If you submit reviews, photographs, inspiration images, testimonials, or other content to us, you grant PoppyLove Creations a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, publish, and share that content for business and marketing purposes. You retain ownership of your content and confirm that you have the right to provide any content submitted to us.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately if you believe your account has been accessed without authorisation.

You agree not to:

• Use the website for unlawful purposes
• Attempt to gain unauthorised access to our systems or accounts
• Interfere with the operation or security of the website
• Submit false, misleading, or fraudulent information
• Copy, scrape, or harvest content from the website without permission

To the maximum extent permitted by law: our products and services are provided on an “as available” basis; we do not guarantee uninterrupted access to our website; and we are not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of our products, services, or website.

Nothing in these Terms limits, excludes, or modifies any rights that cannot be excluded under Australian law, including rights under Australian Consumer Law.

Customers should follow all application, wear, care, and removal instructions provided. PoppyLove Creations is not responsible for:

• Allergic reactions to adhesives or related products
• Damage caused by improper application or removal
• Misuse of products
• Failure to follow provided instructions

If irritation occurs, discontinue use immediately and seek appropriate medical advice.

PoppyLove Creations is not responsible for delays or failure to perform obligations where such delay or failure results from circumstances beyond our reasonable control, including natural disasters, severe weather, supplier shortages, postal disruptions, internet outages, government actions, industrial disputes, or other unforeseen events.

Your use of our website is also governed by our Privacy Policy. By using our website and services, you acknowledge that personal information may be collected, used, stored, and disclosed in accordance with our Privacy Policy. Certain services provided through our website may be operated by third-party providers, including Google for account authentication and Stripe for payment processing. These providers may collect, use, and process personal information in accordance with their own privacy policies and terms.

We may update these Terms from time to time. Any changes will be published on this page together with a revised Effective Date. Continued use of our website after changes are published constitutes acceptance of the revised Terms.

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of our website shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
